Hi everyone,
Our I485 was denied inJan 2009 and we filed for MTR which they received on Feb 3, 2009. As of today the case is still pending and i just found out a couple of days ago that our EADs were not valid during this period, but actually we never stopped working.
I kept calling USCIS but they kept telling me to wait and that they couldn't put in a service request because we can't establish that our case is outside processing time since USCIS doesn't provide an average processing time for I-290B. So finally today I called again and I said it is not normal for this case to be pending for so long and i mentioned "severe financial hardship". They told me if I feel like I could be affected by not having this case decided on faster I can invoke that motive to have it processed faster. So that's what I did and they told me i should have an answer within 5 days.
Do you think it could work? My lawyer later told that was a bad decision because now I have bigger chances of having the case denied because USCIS will do it in a rush instead of taking time to look the case an the facts over carefully.
Has anyone been in this situation? Any ideas?
