RENEWAL of EAD question

this is not efilng case,
I sent the RENEWAL of EAD for my spouse and I sent:
Fee$ 120
Form I-765
Top Portion of the latter that was sent with First time EAD card
Valid I-94 both the sides
Copy of I-485 filling receipt of spouse
Copy of Marriage certificate

*** I forget to send copy of I-140
Service center VSC, do you see any issue because of not attaching copy of I-140?

I thought that it is for the spouse and her I-485 receipt clearly states that for Dervative status I-485 pending and did not attach I-140.
 
Generally it is not required, unless they suspect this as a concurrent filer.
If you are a concurrent filer, after getting the receipt notice, you can send the copy of I140 receipt notice with EAD receipt copy to BCIS

It is not concurrent filing, I filed my I-485 and spouse I-485 based on approved I-140 in June 2002, and EAD AP for me and my spouse were issued in September 2002, that is why I attached the Top part (that was sent with EAD card) that they requested to send when Renew the EAD, just did not send copy of I-140

I read in other post that they sent RFE for copy of I-140 and got worried

don't worry about it. In some rare cases BCIS may ask for I-140 notice. For "renewals" I don't think it's required. I applied for my EAD renewal in May and didn't sent I-140 notice. I hope that I'll get the approval.
