Renewal EAD approved - 1/23.
Still waiting for EAD card.

Travelling to India - 2/6.

1) Is it safe to travel out of U.S without having the EAD card but with valid AP?
2) Is it enough if I carry the approval notice printed from the status website?
3) I will have the EAD card mailed to India before I retrun back to U.S. Will this be ok as I'll have the EAD card with me on my entry back into the U.S??

Experts, opinions please.
thanks.

Do not need EAD

You do not need EAD to travel. EAD and AP are for totally different purpose. I came back to the USA twice without having to show EAD

Hi, Plasticcard & TSC Hopeful:
When you came back, were you paroled INDEFINITELY or only 1 year. If it is 1 year, is it paroled 1 year from the date you enter or is it valid only to the AP expiration date? Thanks.

cxqiu:

When my wife came to US on 05/28/2002, even though her AP was expiring on 12/23/2002, the INS officer stamped (the passport, I-94 card and the AP form with) the expiration date as 05/28/2003 (1-year from the date she came). Hope this helps.

Thank you, Bajis. Seems 1 year parol from the date of entry is what INS does (The concern came from what I saw somewhere. It said reentry with AP would be paroled until the AP expiration date) while the leagal status of a parolee ramains more elusive after 1 years passes. Anybody has any idea? This is all coming from the sloooow processing of I-485 adjudication. Hope the long waiting ends soon.

Depends

I have come back twice on AP. First time the expiration date was only till the last day of my AP expiration. Second time on Dec 28, 2002 it says "indef" for both me and my wife. Port of entry both times was Dallas. So I think it depends on the officer.

Hi, Vettipuls:
You really opened a can of worms for possibilities. I was assuming that the parole period would be 1 year OR until the expiration date on the AP starting from sometime June/July 2002. Now you brought us with a "Indef" on Dec 28, 2002 in Dallas. Was it a late Christmas gift? Myself did come back with "Indef" in April, 2002, which is how INS did for I-485 adjustee at that time. I'm assuming you are one of those waiting for I-485 approval.
Thanks for the post. Anyway, does anyone have more info to share?

Immigration officers may write different things on the Advance Parole document or I-94. These include:

AOS Indefinitely
AOS (Date of Advance Parole doc expiration)
AOS (1 year from date of entry)

Regardless of what is written, you are paroled or allowed into the USA indefinitely until your I-485 application is determined. You may NOT go out of USA and return after the Advance Parole doc has expired.

EAD Renewal card recvd

My wife's EAD renewal was approved on Jan 16th and we recvd her card on Feb 1,03. Took 2 weeks exactly. Hope this helps. Thanks.

Hello Vettipuls

When was your wife's EAD renewal ND and RD?
I 'm just estimating how long does it take for EAD approvals?

EDW2002 her RD was in June 02, ND was in Sept 02 (24th I think) and she got the approval on Jan 16, 03. Card was recvd Feb 01. Both of us filed at the same time for renewals. My RD was also June 02, ND June 02, approval in Sept 02. For some reason hers took very long. But the average time now for EAD renewals if 4 months. Hope this helps.
