Register a LLC on H1B

On H1B, Is it possible that to start a LLC now but not begin any operations for say 6-8 months.(Just register a name and keep)
Does this have any tax implications or any other legal implecations?
 
Any one can start a LLC, even a foreigner out side USA.

h1 can be obtained for that LLC.


Once company is registred, you have to get Tax id inorder to open any bank account.

h1 can start llc but cannot work for that company for/no salary unless your company sponsors you.

here is the catch-22: somebody in that company has to sign to sponsor h1 for you. signing is an unauthorized work and is illegal. you cannot hire someone to act as temporary ceo an sponsor because again "hiring" is a work and is unathorized which is illegal.

you are better off starting the llc with a partner who has unrestricted work authorization preferably greencard holders or citizens even though ead holders will do.

non-activity does not mean anything for you. anything you do for that company is work. getting tax id or filing tax return for that company is also work.

most state gives the option to "reserve" name for a company. this way the company is not formed but just the name is reserved. but there are some time limits depending on state.

you need to consult with cpa and business attorney prior starting a company. all tax, legal formalities are applied depending on form of business. its worth consulting with professional before you decide on llc or corporation.
