Regd legal status

Hello Rajeevji,

I have following two questions regd status

1) Right now I am on H1-B. I have applied for I-140 OR and also I-485. I did not apply EAD for me but I applied for my wife. She got EAD last week. If shes uses EAD, does it effect my H1-B status?

2) My wife applied for H1B last year (2008 April 1st) but her H1B is pending right now on employer's financial query. Her student OPT EAD expired on Nov 2008. Right now her status is on pending H1B. She got EAD recently with my I-485 application. She won't be able to use her EAD for three months as we had a baby last week. What will happen to her status If her H1B got canceled. Is it must for her to use EAD immediately to be on status?

You need to goto the H Visas Forum. I would redirect it so you can have a conversation with people who know about H1-B Visas. :)

-------------------she has her I-485 pending and her status is AOS pending. EAD is not status EAD is for work.

I appreciate your help.
