Regarding I-94# On I-797A

Hi,
My First H1B Visa expired on 22 May 2008. I went to India and came back on Dec 01 2007 and i got a I-94 when i entered the US in Dec 1 2007. My Employer filed for my extension on April 30 2008 and he filled in the wrong I-94 number( The I-94 number which i have before i went to india in Oct 2007) in my H1 extension forms. I got my H1 approval from may 2008 till april 2011.
But the I-94 number on my current I-94 card attached to the Passport is different from the I-94 number on the 1-797A form. Will this be a problem? If i t is problem, Please let me know what are the necessary steps to be taken. Any help will be appreicated. Thanks in advance.

--------------No, you have valid I-94 attached with your H1 extension approval notice and that is your Latest valid I-94. if your old I-94 has number 1234567 and New has 345789126 it does not matter.

This is not a problem, it is correct. Each admission into the U.S. is suppossed to generate a new I-94. The extension approval is a new "admission" under relevant provisions of the INA.

I went to India and came back on March 2009 and i got a I-94 when i entered the US . My Employer filed for my extension on November 18 th,2010 with Premium Processing and he filled with the wrong I-94 number( The I-94 number which i had with my earlier approval notice prior to March 2009) in my H1 extension forms. I got my H1 approval notice with new dates from Dec 2010 to Dec 2013. But the I-94 number on my current I-94 card attached to the Passport is different from the I-94 number on the 1-797 form. The I-94 number on my current approval notice is same as what he has given incorrectly(same as the number prior to my travel)

I came to know this problem when i went to DMV office for renewing my driver license. The DMV officer entered I-94 number from my current approval notice and mentioned that he was not seeing updated dates in his system. Is that because of my incorrect I-94 number used in my filing ? DMV officer refused to renew my license.

I explained this sitiuation to my Attorney and he said it shouldnt matter and told me to try again in DMV. I am out of options now...

Please help me in this matter what are the necessary steps to be taken. Any help will be appreicated. Thanks in advance.

-----Employer/lawyer was supposed to write the WHITE I-94 number that you got in March 2009 when you came to US.
I got my H1 approval notice with new dates from Dec 2010 to Dec 2013. But the I-94 number on my current I-94 card attached to the Passport is different from the I-94 number on the 1-797 form. The I-94 number on my current approval notice is same as what he has given incorrectly(same as the number prior to my travel)
---------------- The I-94 that is attached with your H1 extension approval notice is your LATEST I-94. you need to attach that to your Passport. Number of I-94 does not matter.

Yes..I understand my Attorney Supposed to write my latest I-94 number of March 2009 in I-129 petition. But he made mistake and wrote incorrect I-94 number which is earlier to March 2009. So You mean it shouldnt be a problem?

DMV officer put a request to Immigration department verifying my status. And he mentioned it may take 1-2 weeks to get the feedback. Now my license is expired and cannot drive. I am just waiting from DMV office to hear their feedback.

Hopefully i will hear positive feedback from DMV...

Iam in a similar situation now.I got my approval notice for H1B renewal but there was a misprint of date of birth.So I sent it for correction and received the corrected notice but with a new I94 number different than one in the passport.

Planning to go to India for stamping....Will the mismatch of these numbers create any problems.


Please please advice.

-----it does not matter if your LATEST I-94 number is different. It is your valid LATEST I-94 and attach that to your passport.(keep the copy of ALL the I-94 front and back for your future records)

-----Not a problem. when depart US then give ALL the I-94 at Airline counter (staple them and Latest I-94 at Top)
