regarding H4-H1-H4 issue

Hello,

My wife was on H4 status from February 2000 to September 2001 (So her H4 is valid till Janurary 2003 and she has H4 stamp on her passport). Then she got her H1-B approval in September. She still has not yet obtained visa stamp for H1-B on her passport but has obtained a social security number based on H1-B visa. She has not yet worked for the employer who filed for her H1-B and we don't have any paystubs.

So do I need to file for a new H4 if I want to change her status from H1-B to H4 or her previous H4 visa is still valid?

she is ok

however she needs to one of the following
1. Ask employer to withdraw h1
2. Go out of US (to canada/mexico) and get a new I94 based on the h4 stamp. This is just to reenforce the h4 status. By getting the h4 I94 , she would have superceded the h1 I94. Remember, she have to apply for a h4 to h1 if she decide that she wants to go back to h1...

I was going to ask my lawyers to file for a new H4 for her. So in your opinion I should not ask my lawyers to file for new H4. Please correct me if I am wrong. Also do I need to ask my lawyers to do something else or not?
