regarding 245

Hi,
My i485 has been filed under 245 (my lawyer didn't mention 245(i) or 245(K)) on May/2002. But I paid $1000 fee because I was out of status(without job) 45 days. Now my lawyer is saying I can't leave the country untill I got GC. Can anybody advice me Can I send any amendum letter regarding my case will go under 245(k) not 245.

Do you have a copy of your 485 Pettition?

or you are assuming that the 245() was not mentioned?

or u have concerned about $$$ was paid but not sure for what....

Check your pettition if u can get a copy of it.

and to keep track the $$$ INS had sent u the receipt in that receipt you will find the I-485 Application fees + $!000 you paid .

if u don't find the $$$ amount then don't hessitate to talk who submit ur pettition.

But don't panic. ..... just relax even pettition is missing what catagery ... RFE will be issued.... so just relax...

I always encourage do follow your pettitions, make always copies of your pettiton (if possible). and keep all receipt with u. even you got any approval or notice ... get copy from your Attorney. you should have all record because this is ur pettition and ur case.

PD,RD. ND, RFE.. I-485, I-140 EB?? catagery and AP etc...

May I ask, if you dont mind telling that, is your AOS employment based ? And what made you went out of status, did your employer cancelled your H1B ??

If your AOS is employer based then your case is 245(K) and you didnt have to pay the 1000 fee which was required for 245(I).
 
Check or ask the lawyer for I-485 filing receipt, if it was 245(k) you did not pay $1000, you were out of status for 45 days and your case should be 245(k) if lawyer did some mistake fire him and ask your fees back from him.
