@Sm1smom How are you my case was denied after the interview the interview was quick I was only asked about what is on I_485 the officer never asked me about my current status and there is no clear reason for the denial I have pending asylum status + tps pending , the reason for denial mentions my entry date and b2 status expiration date and the date mentioned was not correct I did not have any days out of status neither pending asylum nor tps was mentioned in the denial decision I want to file an appeal.
I do not know what to do!
time is short I want you to give me advice what can I do?,
Can I expedite my TPS so I can apply for a motion to reconsider/ motion to reopen!?. If so, what shall I tell them as a reason for expedite?.
Your advice is highly appreciated.
 
Sorry to learn about your denial. But there’s nothing you can do about it at this point if your current status is asylum pending/TPS pending. You have no valid status to AOS from is what that means. You are currently out of status, regardless of when you filed for asylum or TPS.
 
@Sm1smom Thank you for your quick response. If the TPS is approved now, can I submit an appeal with the TPS approval letter attached, because as I understand it, the TPS is considered a case, or is there no chance for me at all, even if the TPS is approved before the end of the fiscal year?
 
It depends on when the TPS approval is effective from. If the approval is effective from when your B2 authorized stay expired, then a new AOS application can be approved (if there’s enough time left to do so). If the approval is effective from after your authorized stay expired, you’ll still be ineligible to file for AOS and any new application will equally be denied.
