called NCSC today, they will send a request to VSC. Don't know if that helps or not.

It's time for us to send our letters to the head of VSC. We need to let them be aware of this unusual delay for us.

It seems nobody is working on our cases. I really don't understand why it takes months to clear the security check. Isn't it just a couple of mouse clicks? Where is the hi tech?
 
i'm a local transfer case but having the same problem for 3 months (5 months more delay before they sent fbi the check request).

my guess is:
1) the two systems at bcis and fbi are not fully integrated. from what i read, somebody said it can be done within an hour(electronically), while others waited for months. somebody recently also said they're improving the communication by only raising flags for those suspicious, instead for everybody (i doubt this.).

2) the special alien registration took both fbi and bcis too much efforts. there're a lot of people are waiting in jail to be checked and deported. i guess they all need to go through this security check process, too, and they're of higher priority to bcis and fbi. i think this is why we saw less and less cases are being transfered to local (although there're some) because most local officers are handling the registration cases. vsc is faster because they might be less affected. for those who got transfered recently, i found their interview dates are either not decided or months later.

I think it does no harm to call them, since we've been already pending 20 months. I haven't received response from VSC yet for my 1st inquiry.

Just sent a 2nd inqiry today, let them know there are still some over due cases.
 
could you please tell me?

does everybody need to do security check for I485? Where to do it? And what are going to be included? My lawyer called INS they said they are waiting for the security check result. Otherwise my case will pull on complete adjustication.

We Must Do Something About This!

Count me, too!

My co-workers who filed their I-485 applications at about the
same time were all approved early this year. I am the only one
left behind in my company.

I called the BCIS several times since July, 2002. They always told
me that my case would be processed in a month or two. However,
that was not what was happening. It's been a year and my case
is still pending.

According to the Senator who contacted the BCIS on my behalf,
I haven't passed the security check. If the State Department
doesn't OK my security check, my case will not be approved.

I did a second fingerprint recently, and still don't see any sign
of hope.

Now they have started processing January, 2002, cases. This is
so unfair to us. Can we all get united and file an appeal to
the BCIS? Or do we need to hire a lawyer on behalf of all of us
October filers? We shouldn't wait any longer!!!

You have failed security check or it's just not complete yet? I am stuck here because of the same, I guess, although no IIO or Senator office specifically mentioned security check for my case.

I completed my 2nd FP last week and have no idea how long would it take more.

And also, what does state department has to do with the security check?

Does any one has a complete picture of what security check consists of?

Cases Files in October, 2001: Security Check

Only God knows what the secuirty check is!!

According to the Senator who contacted the BCIS on my behalf,
my case has not been approved because I haven't passed
the security check.

I did a second fingerprint, and still don't know when I can
get approval.

So I called the FBI this morning, they told me they had already
screened my second fingerprint and sent the result back to BCIS.
There are other goverment agencies who conduct security
check upon request by BCIS.

I asked what these government agencies were so that I could
contact them. The FBI said I needed to call BCIS to get the
list.

But, the VSC has cancelled their 802 phone number. I can't talk
to them directly any more. I have to call that 800 number, so
as I did. They said they would forward my inquiry to VSC.

I will fight for this unfair treatment. I've contacted Rajiv's law
firm and send him a draft petition. Please take a look and
forward your related concerns to Rajiv. He's willing to help us.

Subject: Backlog in the I-485 application processing

Dear Director:

We are writing on behalf of the individuals who have signed
the attached petition and countless others affected by
the interminable delays in the I-485 petition process.

These individuals filed their I-485 applications as early as
October, 2001. However, their cases have not been processed
while cases filed as late as January, 2002, have been processed.

The unreasonable delays in processing of the Adjustment of
Status applications are a cause of grave concern to these individuals.
People have no security or predictability as to the outcome of
their cases.

We invite your attention to this most urgent and pressing problem -
the severe delays in I-485 cases filed in October, 2001.
Please help these people attain speedier adjudications in the interest
of fairness, justice and good conscience. We as a community
stand ready to assist in any manner we can.

We would appreciate a response back from your office about the steps
that have been taken to deal with this most pressing problem.

Seems to be caught in the cycle of filing EAD and Advance Parole - twice so far!

Attorney is no help at all.
800 number - engage tone all the time.

Looks like only God can Help & Bless us all !

800 number experience.

I called the 800 number.
She read the status of the case, which I see online everyday.

I pointed out that case took longer then 540 days and asked what is the reason for delay.

Then She took my phone number and e-mail id.
and told me that she is going to send electronically information to VSC. So they will contact me with the reason for delay.

But 24hrs about to pass. Nobody made a contact from VSC.
 
Petition Letter

Hi Guys:

I just spoke to Rajiv's office. They are working on a petition letter
to be sent to the BCIS VSC on our behalf. This will help speed
up the process of our delayed cases.

According to his assistant, a link to the petition letter will be
ready in a week or so on both "immigration.com"
and "immigrationportal.com". Please be alerted!
Sign the letter there before it's too late!

Check these two web-sites in 5-7 days! This is our only hope!

At the same time, I'll work on the letter as well. I want to add
a section about the security check. What it is, why it
has to be done in the dark, why it holds back our innocent
people, etc.

Any more ideas welcome!

Addition to Petition Letter: 800# and Security Check

Good suggestion. I'll add a comment about the 800 number
in the letter. Also please review the comment about
the security check that I intend to include in the petition letter.

Recently, the VSC has cancelled its regular inquiry phone line.
Individuals have to call an 800 number to talk to a live
representative.

According to the feedback from many individuals, this phone
line is a message forwarding system. They would relay a
message to a corresponding service center. The service center
will normally get back to the individual in about a few weeks.

This relay system keeps the people distant from the source.
It is inefficient, evasive, and error-prone due to the nature
of a message relay system.

If every individual who applies for an adjustment of status needs
to undergo a security check, the procedure of a security check
should be a public policy.

Among the people who share similar backgrounds, some have
got their approvals, and some haven't. The only difference is that
they have not passed the security check.

On behalf of these affected individuals, we are interested in
knowing what comprises a security check, and why the
individuals are not given detailed information about a failed
security check, as a result, they cannot provide necessary
information to related agencies.

When an applicant has to do another fingerprint due to a delay
on the part of the BCIS, their applications should be given a
much higher priority. However, that is not the case.
