Hi, my friends here

How are you doing! Happy new year! I know many people here are knowledgeable in asylum cases. I really need your help. Any help will be strongly appreciated. My questions are below.

1. I am involved in my dad’s application. We were interviewed and got recommended approval on April 2001, but we have not gotten final approval yet. I’ve been to San Francisco asylum office many times, every time the officer told me that our case is still pending due to the FBI background and name check. It has been more than 4 years, but still no news. I really have no idea. I don’t know what should do about this. Anybody knows?

2. Today(1/13/2006) I walked to S.F. office again, but still the same answer, still pending. I was told that they are waiting for name check result and A file of my dad. There is a letter A located before my dad’s A# and a letter T before my A#. The officer said my dad’s file is A file and mine is T(Temporary)file. Anybody know what the letter A and T mean? Please help me!

The "A" file is your regular immigration file and the "T" file is the temporary file they create for you when they cannot loate your regular file.

Five years are exceptionally long. You need some help to deal with this. Please retain an experienced attorney who will contact USCIS headquarters for you.

Does The T File affect my case? Thank you!

Thank you for advising the meanings of A and T file. I wonder if T(Temporary) File affect my application? (I am included in my dad's application).

Please contact the following Law Office

Dear Wait-Lee,

From my past experience, after you receive recommended approval it will take about 2 weeks to receive a decision for Final Approval. Since four years has past, I recommend that you seek an expert attorney for your case. And since you're in San Francisco, I suggest that you contact the office of Robert. B. Jobe (www.jobelaw.com); his one of the top immigration lawyer in the nation and you can read the testimonials and many people that I know who seeks Asylum going through this office, is all successfull. Try and I'm sure you won't be disaappointed. Good luck!

I also got recommended aproval letter but I waited only six months for the final approval letter, I called many times I spoke with asylum officer, I think this speeded my approval.
one advise, try to make an appointment with the Director of the asylum office where your case is pending, do not talk with anyone else, maybe she/he will be able to help you out since your case I think is pretty unusual.
Good Luck

Murray33, you are very lucky that you received your Final Approval only 2 WEEKS after you Recommended Approval. How long ago was this anyway? I've yet to receive my Final Approval too. I sent an inquiry via mail a few months ago and never received a response to it. So I went to the Asylum office last week where I had my interview and initiated an inquiry. They gave me the standard response that my case is still processing (it's been 10 months since my Recommended Approval). However, this lady took me aside and said that this should have been done months ago and that I shouldn't have to wait this long. She gave me the name, phone number, and direct extension of the person who had my file and said that I should call them and find out the status if I dont' hear from them in two weeks. She also requested that I don't divulge who gave me the contact information of this person that currently posesses my file. Hopefully I won't need to call them and I'll get some thing in the mail soon.

I have a question though for anyone that has experience. Will the date of my Asylum be when I receive the Final Approval or the Recommended Approval? It would suck major A$$ (and not in a good way) if the date of Asylum granted would be the date of the Final Approval but I have a feeling it will end up being just that.

You are unfortunately correct that the approval date of your asylum will be the date they issue the final asylum grant. You will be able to file your green card application one year after the final grant. The recommended grant date has no bearing on this.

You're absolutely right Thankful and in your case Asylee, the final date will be based on the Final Approval and your recommended approval date does not count at all. It is so unfortunate that situation like this happen.

Hi, Guacho,

Last Friday I went to the office to ask why my case is still pending. The lady there told me that two things caused my case delay, first, they are waiting for A file, and second, FBI name check is also the reason. She gave me the officer's name who interviewed and let me write a letter to him directly. I sent hime a letter last Saturday. Hopefully I can receive some good news from him. If I don't receive response from him, I will contact the director in that office.

Writing is not the best means of getting this thing moving. You need to be making phone calls. Four years are ridiculous.

No diea!

I asked that lady in asylum office the office's number, but she said I can't contact him through phone call. I can only write to him.

Can I apply AP for travel now?

Than you for kind helps from all of you guys. I have another question. Since I've not left US for almost 5 years, I want to take a vacation to either Canada or UK, can I apply AP based on recommended approval? It states that I can apply AP before travelling abroad. Anyone here has experienced the same situation? Please advise! Thank you again!

I suggest you wait until you receive your asylum approval.

yes you can

Waiting Lee, i applied for my first RTD as soon as I got the recommenden approval letter and got it before the final approval arrived, but I strongly recommend DO NOT apply until you get the approval letter, you have waited too long.
Call the asylum office, try to contact the officer or the director of the office, try to get this letter first before you travel.
