Recently Married on L1A Visa. Please Help - Save my Job

Hello Everyone,
Thanks for taking time to read my problem.

I am in the US on L1A visa and my husband is on a Green Card. He has applied for Citizenship in September '06 in Virginia. He is expecting to become a citizen by June '07.

My problem is that there are lot of people being fired in my company :mad: . Being on L1 visa, I cannot switch jobs. So I urgently need a green card.

Question - Should I wait for my husband to become a Citizen or Apply for green card right now (based on his permanent residency)? If i have to wait, then what are the preparations I can do right now so as to speed up the process - like getting medical exam done?

I am ready to hire a lawyer if that is recommended, however, my husband is of the opinion that its a simple thing and we do not need a lawyer.

Any help will be greatly appreciated. :(

Hi:

He can submit an I130 now, but you cannot file I485 based on it, since you are not immediately eligible for a visa number. Therefore, filing the I130 will not do you any good right now ---- at least there will be no immediate effect.

File I130/I485 package as soon as your husband becomes a citizen. You do not necessarily NEED a lawyer, and a lawyer cannot speed up the process. However, if you feel uncomfortable about the process, you can consider retaining one.

If you fall out of status before your husband is a citizen, filing I30/I485 upon him gaining citizenship will restore your legal status at that point. Depending on the length of your out-of-status period, you may need to not travel outside the US until you receive the GC.

I have couple of more questions if someone can help.

If I file an I-765 (for employment authorization) along with my I-130 and I-485, I am assuming i will get an approved work authorization in 3-4 months.

- What will happen to my L1A visa then? I wanted to keep my L1A visa as it gives me flexibility to travel in/out of US.
- Also what is the best time for getting the medical examination done? Is that something required before filing the forms?
