Received I539 Approval letter after extension was expired

I just received (on 10/3/08) the approval letter for I539 for my mother in law. This stated that extension is approved for Feb 2008 to Aug 2008. And the Notice Date: Sept 16, 2008.
What do I do here? I have called the Customer Service and they told me to make an appointment with the local office.
Any advise will appreciated.

Hopefully, she left in August since an extension would have granted her at most a six month additional stay. If she did not leave, that means she likely spent more than a year in the US during this visit. It was irresponsible of her not to have left properly.

Friends,

Is there any pblm to leave US with expiried visitor's visa? I mean to not get in..

How long it took for approval of extension, if apply? thanx..

She is still in US, I applied for her on Nov 2007. Extension request was for 1 year till Feb 2009. I called Customer Service every month and ask them what should we do and every time they told me to check the processing time for i539. Also, they told me, her status is fine until she receive a decision. Which I got on Sept 16, but the extension expired a month ago.

I am little surprised (maybe not), that an agent is approving something on Sept. which was expired in Aug.

Any way, we made an appointment with the local INS office. I need at least another month or so to make the arrangement for her to leave. Any advise for this appointment?

I know some people (with B2 visa) and they got their extension for a year. That’s not the point, what if INS granted extension for 3 months and send the approval letter two months after the granted extension was expired. According to Customer Call Center "as long the case is pending status is fine."

How would we know what extension they are approving for, unless we receive the notice?

I understand that US is letting my mother-in-law enter as a visitor to stay. Since, there is a process to apply for extension (not like she is abusing it, this is the 2nd time she came up here after 3/4 years). So, we applied for extension to spend more time with her newborn grand daughter.

This might not be a valid reason to INS for an extension. But shouldn’t she get a notice (approved or denied) with some leg room to make appropriate arrangement. Not a notice of approval after the extension was expired a month go.

USCIS documentation specifies that exentions of a maximum 6 month duration may be requested. If you did not read the laws and applied for a year based on something your friends told you, you were foolish. She should have made plans to leave within the time specified in the proper extension application and left even if the extension decision had not arrived.

By the way, according to USCIS regulations, she is abusing visitor visa. She will be quite lucky to ever get another one based on her actions during this visit. If she wants to see her grandchild, you will be going to her home country because of your and her inability to abide by US law.

She needs to leave immediately!

I have been reading a lot about B2 extensions. I'm positive that your mom is out-of-status now. INS does not give 1 year extensions. The maximum a person can stay in US with a B2 visa is 1 year.
