Received FP Notice Today

I am soooo... excited. The wait seems to be coming to an end. I also firmly believe that this has something to do with judge's order of 22,000 pending visas and CIS has decided to move applications quickly.

I don't think it is related to the 22,000 unused visas. They are just preparing the cases that are going to be approved in FY 05.
Just go to the FP appointment and do nothing else other than wait and keep your fingers crossed.
As for the RFE, it is not only related to if you entered legally or not, but also to if you overstayed beyond the date stamped in your I-94. If that's the case and depending on when you entered the US, be prepared for some additional questions.
I know how it feels receiving long waited news from USCIS; just stay cool, be more patient and hope for the best.

Some people with ND in 2001 received request for FP. Mine is in 1999 and still nothing. You have to admit, there is something strange going on here. I would understand for ND in 2000, but 2001?? Maybe they are double checking everybody in the queue? I submitted my FP together with the I-485 application in 99. Maybe these people did not submit FP at that time and USCIS is requesting it right now so that they can do a background check on everybody.

Anyway, I’m not trying to imagine any conspiracy theories :D … just killing my waiting time. I know we have to be patient, but we can also exchange ideas. Otherwise, this forum would be empty … Any toughts?

No! FP notice is not mailed to the same address where I applied my I-485. I moved from one state to another but promptly mailed my change of address form. So now they mailed me FP notice on my current address which is different from the one on my I-485 application.
 
Got my FP notice

Got my FP notice in the mail today. I-485 ND Oct 2000.

I moved twice since then.
 
I had filed I-485 in 1999 and had moved twice. I had always updated the change of address promptly. I had also received my FP notice to my new address but they sent the RFE to my original address for whatever reason. I was thankful that website status was updated so I had a chance to contact them myself and had it sent to new address...

"Illegal" entry is actually more complicated than it seems at first glance.

The most serious type is of course entering on a false passport or a visa. Doing so is a federal felony and people are being sentenced to prison for this type of conduct. Nevertheless those folks' I-602s are being approved very liberally by the CIS.

However even if you entered on perfectly genuine documents, many CIS examiners still think your entry is illegitimate and calls for an I-602. The reason is when you applied for a visa at an overseas American embassy/consulate, you told the State Department interviewer that you only wanted to visit, conduct business, study or whatever. You promised that you would be going back to your homeland. Then soon after your arrival, you sent in an asylum application and sought to stay here for good. To the CIS this means that you always had the intent of settling in the United States and you lied during the visa interview. In other words, you obtained your visa fraudulently by hiding your real intents. So they require you to complete a waiver.



This is a new issue for asylum adjustment cases. It started about one year ago. But this has been a perennial issue for non-asylum cases. For those cases, obtaining the necessary waiver is very very difficult. Everyday a large number of non-asylum I-485s are denied solely for this reason.

Not too long ago someone said here that he is "not concerned" about visa intent and that he would be filing a new application based on marriage. I think this is a pretty ill-informed statement. Unless he could convince the CIS to change its conclusion that he fraudulently obtained his visa (good luck in that), asylum is the best way to obtain his green card. He should have taken the I-602 seriously. Had he done that, he would have received adjustment approval a long time ago (based on AILA information).

Now my question is that should I go ahead and do medical exam (which is valid for 1 year) now or should I wait till RFE. Because in certain instances, some people were just approved after FP without requiring RFE? I don't know how that happened? But do you think that it would be a wise idea to do medical before receiving RFE, as medical exam procedure can take 1 month.

wait...hum....my asylum was granted in LA, then i moved to SEATTLE, my I-485 receipt address is the one in SEATTLE. I NEVER MOVED AFTER FILING I-485
Is that Ok?

i hope they wont mail the FP to my old address in LA, even i dont remember that address.... i did not report to BCIS till 2-3 years after i moved cause i did not really know what to do...

Any suggestion? ANY WAYS i can check my current address in their system?

So afterall these early finger printing notices does not have anything to do with this lawsuit and government is appealing. I wonder how far the government can go to try to avoid giving legitimate green cards to Asylees?
