Received BEC 45-day letter on SF DOL cases

received 45 days letter

Hi:
My employer received the long waiting 45 day letter today and I got a copy, the new case NO is P-04308-331**, the interesting thing is that I got my case NO from Dallas BEC by status inquiry with D-04308-331**, the letter says my company failed existance check, although my company is a public company in NASDAQ, Attorney will take casre of it.
It looks Philadelphia BEC start sending letters for CA RD May 2003 cases.
PD CA 06/11/2002
RD SFO 05/01/2003.
RIR EB2

My employer received 45 days letter from Dallas BEC and responded immediately.How long do I need to wait now to get my labor certified ?.

PD:July 31 2002
DOL Received: July 2003
BEC Letter Received: 10th Feb 2005
BEC Letter Responded: 14th Feb 2005

When they start Process ?
Around Mar/April
When your case might be taken up?
Around May
When your case will be certified ?
Depends upon certifier and your documentation

Please could you tell us how/where you found the info that they will start processing the 45-day responded letters in Mar/Apr...and estimate that rjay's case will be taken up in May?

This will help us guesstimate how long the other cases will take...

My lawyer told me that they have received the letter from BEC last Feb. 11, 2005. I will update the file when I receive the actual letter.

That was an estimated guess
DOL said they will do transfer untilll end of March 2005
SO becs majority staff must be doing Data entry
Understand from other threads a very few analyst have been assigned to start processing for the replies recieved. Also BEC is trying to establish a national standard for Restrictive Requirements, which is different for each state.
Even though trickle starts in April , Full steam should start by May.
That is total of 4 months of No Aprrovals from Bec, since they started functioning and down the Drain Million $$$ Tax payers money.

ETA-P04308-XXXXX.
As per my understanding middle number is julion date, while entering case number to their database.

Your PD is 06/02 and mine is 08/02.

Are BPC going to process according to julion date of entry or according to PD?????

If they are processing through PD then why they require
julion date which is in the new case number.

I believe BEC will process in FIFO (based on PD & 45 Day Letter Response).. Julion data has been used in case number to stramline cases as they entered in to system
 
DOL/BPC don't follow any logic. :rolleyes: They opened the box and entered into the system. Hope BPC will follow logic in future for adjustment :)

The Case nos. are just file unique nos. by location of BEC center.
Chances are that nos. can be same for Both centers except the Letter P and D.
They start process based on replies recieved & by PD date.
In a laymans term when analyst logs into system he will be presented with a case which has earliest PD with reply recieved.
The next case will be in same above order, which means once the replies are recived the PD will be important and jump ahead of Q even though replies are sent late.

PD - Beginning of Dec 02
RD - End of Oct 03
EB3/RIR
