Receipt Notice Lost !!

I have applied for I-485 during the first week of Jan\'02. I never received my receipt notice. When I called INS they told me that the notice was mailed on 01/09/02, they also gave me my LIN number. They also told that they can not issue a duplicate receipt notice.

Now I am assuming that my receipt notice is lost in mail. I want to understand that what are the risks/problems associated with not having receipt notice. Is there any action I need to take in this situation.

if you have already applied for AP/EAD no problems

otherwise how do you prove that 90 days have passed since RD/ND for applying for iEAD. apart from that if you dont plan to travel and you knwo your lin # you are ok. Just order the check from the bank with which you paid for the 485 fees and you haeve your Lin # and proof of payment date to the iNS
 
I did not apply for EAD....

Can I apply for EAD now without receipt notice? Do we need receipt notice during any stage of the I-485 processing?. Thanks

If you had retained a lawyer to apply for you then you could get a copy from him/her.

Although you need the receipt notice...

for EAD, write a letter that explains that you have not received the receipt at any time (of course generally the lawyer receives this) and mention the LIN. Do not get scared. Better yet, hire a lawyer. Maybe they can get to INS respond for a fax inquiry with the receipt number and you can use the fax from INS as your evidence of 485 receipt.

you don\'t need the receipt notice to apply for EAD what you need is the approval notice of your I-140(employment petiiton) or I-130(family petition) to apply for EAD or AP, so don\'t worry about it, as long as you know your receipt number on your I-485 you can check your case status anytime...you\'re gonna be alright...

I called INS and spoke to IIO, upon my verbal enquiry they have sent me a letter which states that my application is filed at the service center, the letter has my LIN number and it also states that a duplicate receipt notice can not be issued.

The only problem I see here is that the letter is very generic, it does not look like on INS letter head and it does not have any signature. It has a number M-180 on it.

You should be OK....

I don\'t think you really need receipt notice at any stage of I-485 processing.
 
Birth Certificate for I-485

Hi,
  My birth date is by mistake noted different during my schooling, And when we came to know abt it in India , it was too late, because I already had my passport from my school certificates. And changing all the way to back was not possible, because at that time my primary school was shut down. Now I am stuck up with the different dates in my passport and Birth certificate,
Hence my passport, visa, Degree certificate, school leaving -- all these records has one date and my birth certificate has different date. One option was to get the Non-Availibilty plus two affidavit from India, But, my city municipal is not giving Non-Availibility certificate, because, they knew that my birth is registered (on different date than registered in my schooling!!). I am really confused, what should I do.? I have never used my original birth certificate for any purpose, because, it created always problems. Till now school leaving was used as a substitute for any paper work. But for I-485, its required to submit the Original Birth certificate, Or/otherwise Non Availibility certificate . My original BC date will not match with any of my BC records in usa, and Indian government is not giving me Non-Availibilty certificate?. What Should I do.? Any help is greatly appreciated...

Just get 2 affidavits

You don\'t need a non availability certificate. In the affidavit from your parents (or elderly relatives). Add a para stating that the Municipal corpn. is not giving any letter and so we are giving this affidavit to ascertain the birth info given in the passport as the true one.
If you have not filed your 485 file it now with these certificates.
Later you can try different things
1. Get the municipal authority to give a non availability certificate for "somebody else" or for a "different birth date". Figure it out.

2. Get the Indian consulate to endorse your certificates and give a document equivalent to BC.

Have these ready when (if) you get a BC related RFE from INS. INS believes individuals than govt. entities.
