Recapturing time spent outside US

My H1B will expire in Sept 2003. I was out of US for 2 times for 64 days (first – 37days, second – 27 days). My employer is planning to apply for H1Bextension for 64 days in next month.

Is there anyone get H1B extension recently for the time spent outside US?
If so, What was the duration? Whether it was related to vacation or business or others? What is the extension fee? ($1000 + H1B extension fee or normal H1B fee)?

Could you please write your experience or ideas?

Thanks,
Ashkar.

Fees are normal. You need to document the days outside US. But BCIS might not appreciate this nickel and diming. I remember in murthy's chat 6 months ago where she answered that unless the time saved is significant (3 months? 6 months?) possibility of H1 extension in such cases is slim.

When I spoke to my attorney, he told me that the time I spent outside US should be unpaid vacation, if I was paid for the time i spent outside US then he told me that I cannot use that time. So he didn't apply for my extension. I am still working with the same company in their overseas branch.
If your attorney will file for the extesion then you can wait for the decision, we never know about the BCIS.

Thanks Jaxen and RJR.

Hi RJR,
I was unpaid for 50 days and I didn't get pay stubs. I worked for different employers during the vacation time. Now I am working some other employer.

What are the documents to be produced for unpaid vacation?

Hi Jaxen/RJR,
I spoke to my lawyer today he told me that I would get an extension for 64 days definitely. The time spent outside US could be unpaid or vacation (not relates to business). The extension fees is $ 1000 + H1B extension fee.

Thanks,
Ashkar.

That's a wonderful news, It's something which will be useful for others in the fourm. Please update after you file ur H1 extension.
