Recapture of vacation taken during non-H1 status

Hi,

Is it possible to recapture vacation time spent outside US for extension of H-1 stay ?. Specifically, when the person was on a different non-immigrant status that time eg. L-1 and vacation period was before the person switched to H-1 status.

You should be able to recapture all the time you are abroad during you are on H1 and L1, and recapture the time in the US during you are on status other than L1 and H1.

I am on my 2nd 3-year H1B term (started yr 5). So I have to file a petition before the end of 6th year asking for out of US days to be added back?
