Re-entry permit or entering before 1 year

Hi everybody,

my husband and I are going to the US in September to activate or green card. I will stay in the US but he needs to go back to our home sountry for emplyment reasons.

We're thinking about applying for a re-entry permit for him, since he's not sure how many months he'll need to stay out, but searching on the internet, it seems that getting an appointment for biometrics could take up to 60 days, and he can not stay longer than 15 days once we arrive to the US.

Assuming that he can not get an appointment during those 15 days, how long can he stay out the US before coming back to the US? 6 months or 1 year? we're confused about how long he can stay out because some forums mention 6 months and other 1 year... we don't want to risk it and have problems once he comes to te US for good.

Stay outside US upto a year is OK, Six months is more of a myth then reality, Stay for more than six months are questioned and scrutinized at the time of Citizenship. But as long as he has 30 months of residence out of the last 60 months, even if he had stayed out for more than six months in that time he will still be ok. Stay outside US for over a year breaks the naturalization period. Stay outside US for over a year warrants the need of a Re-entry permit, however if you had the intentions to come back within a year but couldn't because of circumstances beyond your control like Medical issues etc they will still let you enter the country without the RP.
 
I don't understand your post...

You are stating you are going to activate your GC and than you are talking about biometrics...why do you have to do biometrics if you already have the GC?

Biometrics is usually done in the USA if a person chooses to do AOS and before the interview.

Please explain?
 
so.... one more question, does anybody know if he'd have any problem applying for a re-entry permit, righ away, after entering the US for the first time?

Also, any chances he could do the biometrics within a month so he can go back to our home country to finish up what he has pending?

BTW, bentlebee, when aplying for form I-131 re-entry permit, you need to go for the biometrics appointment.
 
Your husband can apply for an RP immediately, and if he asks for it to be expedited (follow the instructions), then he will probably be called for an appointment in a couple of weeks. He can take the biometrics letter and go to an earlier appointment than stated.

Hi, just following up this "old" post I wanted to explain the procedure so far... My husband and I got to the States on Sep. 21st the following date applied for an expedite re-entry, got the receipt letter one week later, and today oct. 16th got the biometrics appointment, for nov. 6, obviously my husband will be back to our home country by that date, since his returning flight is on oct. 21st... so, the procedure can really be done within 3 weeks, and then, PLEASE somebody correct me if I'm wrong, we can show up at the appointment place next week and request for the biometrics to be done since he's leaving before his appointment.... that's true, right???? I think he just needs to take his appointment letter and passport and they can to the biometrics....

Could somebody please confirm this REALLY can be done????

They only allow you in with an appointment otherwise they will sent you out. It is not a walk in clinic. The rules are strict and you have to be on time....they check your name in the computer with the appointment...

We had the biometrics appointment changed for my friend since it interfered with her school schedule and requested a new date and provided some dates that would accomodate her and luckily one of these dates was honored but it takes acouple of weeks to hear back from them and you have to follow instructions on the notification for the biometrics appointment.

Hi Lluna,

You should definitely try a walk-in biometrics. Several people have done it successfully as part of the AOS process. Take you appointment letter and any other documents for which they ask in that letter, and explain your husband's situation. You should be nice to them, do not be pushy.

If they refuse you, go on the next day as well and try to approach a different employee.
You should try to go there on Monday, so you have a couple more days to try if that one fails. I have seen some people recommending to go there in the afternoon (after lunch at least) when they are less crowded. But make sure that you know how long they stay open.

Hi, just wanted to inform that we tried the walk in and it work! they just wanted to make just that we got the letter, and they did not even check the appointment date, checked his passpord and we were out in no more that 15 minuts.... all in all a super fast procedure! So the next question is, does this mean that his re-entry permit is going to be approved?
