Re-entry permit--keeping a valid RP while applying for a new one

Hi, All,

I am planning to apply for a re-entry permit. My current RP is expiring within a month. I want to keep my current RP, as it has my travel records, which I would need for my naturalization. I red in many places that one cannot keep a valid RP with him/her while applying for a new one. If include a letter with my I-131 application and explain the situation, would USCIS make an exception in this case?

Would appreciate if you could share your experience.

Hi Gino,

by the time they process your RP in about a year, haha, yours would have expired, so there shouldn't be a problem. On the application form, I suggest you say that it 'will expire' and indicate the date. No sweat. You can keep an expired RP.
 
I echo above comment. I used to keep all my expired RTDs. USCIS asked me to return all my retired RTDs before they approved my gc application.

I supposed you can make a copy of your re-entry permit, including the pages with stamping and visas stamps, so that you have a record.

I'm surprised that they asked you for all your old RTDs before they approved your GC application. This was not the case for me or my family. We didn't have to return anything. Did they return your RTDs after approval of the GC?

No, the NSC did not return all my expired RTDs to me after approving my GC application. I wanted to keep them as souvenir, unfortunately, I had to return all my RTDs. Of course, I would rather get my GC than keep all my RTDs as souvenir.

There is no such thing as "standard procedures". I am not surprised that each applicants have a bit different experience dealing with USCIS.
 
Well, I've written a letter to USCIS asking them to expedite my RP application, which was submitted at the beginning of August of last year. My RTD expires on the 20th of June, before which I have to apply for an extension of my Dutch visa (I am studying here). They won't issue me the visa because I don't have a document that's valid for the time... SO, I am requesting USCIS to send me my RP. I said in the letter that I'd prefer to keep my RTD because of the visa in it, and that it's expiring soon anyway, plus I don't want to be left here with no valid travel document. Someone on this board said that they once had 2 documents on hand. Do you think this will work?
 
You cant have two same valid documents at the same time. USCIS will cancel the old one before they approve you the new one. They may ask you for the old document, and if so they will hold the approval of the new one till they have the old one.

If you report the document lost in order to keep your dutch visa, it may complicate your case even worst.

I'm just trying to see if they will issue me the RP while I still have my RTD. I don't know who it was on this board (wantmygcnow?), but he or she said that he or she had, at one time, 2 valid documents on hand because he or she provided a valid reason for it. Of course, if USCIS asks for this one back, I will comply. And, I am definitely not going to report it lost. I don't want to deal with the hassle of a secondary inspection each time I re-enter the US.

By the way, is wantmygcnow male or female? It just occurred to me that we all "talk" to each other so often, yet we know very little about each other. I am male :) It's also funny that our countries of origin are central to our discussions, yet they remain anonymous. We all have a very strange relationship, only talking about immigration issues (with the occasional human rights discussion)...

What ccordova624 said was correct. They won't issue you another document if one is still valid. What had happened to me was that I sent an application for the new one and keept the old one, by the time new one got processed, the old one almost expired(2 days or so had left) and the officer who was processing my case didn't care and sent me the new one without asking for the old one.

So just apply for the new RP and write in ur application, 'IN POSSESION - Need for travel". After a year or so when your application is up for review, they will see that the old one is expired already.
