Re-applying for a new H1-B after 6 years

My H1-B visa expired in January 2005 after 6 years. I left the US immediately in January and am in Canada since then. Now, I have a job offer in the US, and I want to know if I can apply for a new H1-B visa (from 20K quota) before January 2006, with a start date in February 2006? Or Am I not even allowed to apply before January 2006?

Anyone who had similar experience or have any idea about it? Please share. Thanks.

If you have Masters Degree from USA, you can apply for 20,000 quota in Feb 2006 to qualify another 6 yrs H1.

If you do not have Masters Degree from USA, you can apply your H1 Apr 2006 to qulaify for your another 6 yrs H1

Can you please explain how additional 6 years work? My situation is somewhat similar as my 6 years will be over around May'06 and I was wondering if there was a way to extend that. I have LC pending from Nov. 03 from the prev. employer and my attorney told me he could file for 7th year extension along with the new H with the new employer. If another 6 years is possible, why would he not want to do that? I have a masters degree as well.

If you do not have LC pending 365 days, you can not extend beyond 6 yrs period.
Even if you have LC pending you will get only one year extn at a time. You have to renew your H1 every year based on the pending LC.

Kindly reply .My H1b is expiring in june 2007 can I apply for new fresh H1b in april 2008 (before 1 year) with H1b starting date at Oct 2008
