I-485 RD-10/4/01, No news for approval yet. Had EAD renewal sent out last week. Got layoff notice and off payroll date is Jan.31, 03. Should I wait and look for job till I get approval or should I start looking now? Is it a little easier to get a job with GC than with EAD only? Thanks,

You can get contract job either with EAD or GC(not hard in NYC).
 
Can anyone help with pointers to websites, bulletin boards, or newsgroups that discuss pros and cons of different contracting companies?

Also, if you find the contractor opportunity by yourself, but have to find some contracting company to go through, what's the minimum % they take to give you a W2 (if no benefits are needed)?

you have not mentioned about when does your ead expire. it seems like you have enough time before your termination date and you should most likely get your ead before end of jan. and so you are talking about taking a new job starting feb 1. you have more than two months to look for a job. your dates are alright, don't worry about 485 i would say go look for a job on ead.

when you are interviewing tell your prospect employer that your "authorized to work in US" and you "do not need any sponsorship". don't mention that you do not have a green card. many employers do not understand and you should not put yourself at a disadvantage.

Thank you for your kind advice. I will start job searching soon. So I can mention that " I can work under 'authorized to work in US' and 'do not need any sponsorship'". I hope by end of Jan. I can get both EAD renewal and GC. But suppose the worst scenario happens: I don't get GC approval and job by the time I am terminated, and my previous notify INS. Will my GC case be denied? How long can I use my EAD to look for job and keep the legal status?

EAD Use

Don't worry too much about the worst case scenario, it doesn't sound that bad.

First off, you can work on an EAD while your GC is underway. So, if you GC is taking longer than expected you are entitled to 1yr renewals of the EAD.

Second, if you do not get GC before your termination date, you may still be approved. The problem arises if you are RFE'd for employment letter and/or pay stubs, what do you show in this case? in this case you need to be employed in a position with a similar job description paying a salary that is close to your labour amount.

Third, and I think your worst fear, what if the employer notifies INS as you are terminated. That should be ok too, again you want to be employed. Your employer is laying you off, you did not reneg on your obligation to work for them. You were laid off.

Your employer cannot revoke your 485 application if there complaint is merely a notification of termination.

You have two things going for in case INS is notified:

- you were a good employee, ie: you were laid off.
- even if you chose to quit (after 6 months) you'd be eligible under AC21.

Don't worry too much about your green, focus your energy on getting a similar job with a salary similar to that on the labout application.
