EAD Use
Don't worry too much about the worst case scenario, it doesn't sound that bad.
First off, you can work on an EAD while your GC is underway. So, if you GC is taking longer than expected you are entitled to 1yr renewals of the EAD.
Second, if you do not get GC before your termination date, you may still be approved. The problem arises if you are RFE'd for employment letter and/or pay stubs, what do you show in this case? in this case you need to be employed in a position with a similar job description paying a salary that is close to your labour amount.
Third, and I think your worst fear, what if the employer notifies INS as you are terminated. That should be ok too, again you want to be employed. Your employer is laying you off, you did not reneg on your obligation to work for them. You were laid off.
Your employer cannot revoke your 485 application if there complaint is merely a notification of termination.
You have two things going for in case INS is notified:
- you were a good employee, ie: you were laid off.
- even if you chose to quit (after 6 months) you'd be eligible under AC21.
Don't worry too much about your green, focus your energy on getting a similar job with a salary similar to that on the labout application.
