Questions on I-485 filing with spouse

Hello everyone,

I am on H1 and my wife on H4. I am going to file I-485. I have several questions, and am waiting for your helpful answers.

(1) Does my wife need a separate AOS application package although we are going to send the packges together? In other words, does my wife need a separate filled form I-485, a separte check with $255. a separate birth certificate, a separate medical report, a separate Form G-325A?

I am confused because in the Form I-485, there are an item for spouse and a question for spouse called "Applying with You? Yes or No?" If I check "Yes", Do I need to provide a separate form I-485 and an additional fee for my wife?

(2) My I-140 was filed based on EB1A. Do I need employment letter for I-485?

(3) What is the normal fee for medical examination? I asked one civil surgen and was told it is $125 per person.

(4) Do I need to include tax forms in the past three years? I did not find this requirement in instructions to Form I-485.

--- EB1 is extraordinary ability petition but you wrote you are on H1, if H1 employer filed your GC then employer letter is needed, if it was self sponsored EB1(extraordinary ability) then no need of employer letter as you may have stated on cover letter and evidence for EB1 that you will work in your Extraordinary ability area

--- Better to send past W-2 so that they don’t ask later, It seems to me that you plan to file I-485 with out lawyer, better take the services of good lawyer to file I-485, you may commit mistakes on form.

Yes, I will file I-485 by myself. But you suggest using a lawyer for I-485 because I may commit mistakes on I-485 form. I find that the form I-485 is very simple and straightforward. Can you tell me what kind mistakes people usually make in form I-485.

One can do mistakes, if you still want to save money and don’t want to hire a lawyer to do it then prepare the I-485 package like G325A, affidavit of support for the spouse with all the required documents and fill up the forms and get it reviewed by a lawyer by paying a small fee many do it find the lawyer, If I am in your situation I would not try to mess up the final stage of GC, it is not worth of saving few bucks and latter getting RFE and again finding a lawyer to reply for RFE

Thank Ginnu again. I have gone through the I-485 form, and did not see any confusing items. I did not hire a lawyer for I-485 because I feel the form is easy and the package is easier than I-140. However, I will try to ask friends who have experience with I-485 to review my form.

Can we apply I-485 by hiring a lawyer, Company refuses concurrent filing

Can we apply I-485 by hiring a lawyer, Company refuses concurrent filing, Company filed I-140.But we would like to apply for I-485 too, to take advantage of portability in the future. Can anyone advice.

--------- Get the receipt of I-140 filing and go to any lawyer to file I-485. I-485 EAD, AP belongs to you not to employer.
