Folks,what action uscis has to take when an applicant is found HIV positive?
Special RFE or I-485 denial!

I know for a fact that HIV positive clients are not automatically denied. They even allow new entrants with class A conditions under certain circumstances. I don't know the specific guidelines though, but I worked with refugees admitted with class A conditions which we had to monitor closely and they had to be documented by a public health department.

annaraka are you sure ? coz not loong ago I heard story about a refugee got denied because of HIV
 
It is necessary for that person to submit a waiver application (I-602). You will have to show that the person has been counseled and that he understands what is disease is and how to minimize its spread to others. He must also explain to the USCIS as to how he will be paying for continued medical treatment.

whatewer , but not denial ! be safe for health reason , not gc , etc...
