Hi Lucy,

I asked u for advice few months ago.
I'm an au-pair and subject to 212 (e).
U advised me to apply for advisory opinion and I did about 3 months ago.
In the mean time, I sent papers to my home government and they are sending No objection letter on Monday.
I just opened my case file on Department of State website and I found new information stating that I am not subject and that letter has been sent on September 26th.
I still haven't received anything but I changed my address in the mean time.
Does it mean that I do not need to proceed with No objection letter?
Im a little bit puzzled...
Do I need to erase it from my visa or not?

yes, that means you are not a subject. No, you don't have to proceed with the waiver process and you don't get to erase it from your visa. Simply keep the advisory opinion and whenever you apply for a change of status/adjustment of status, you will provide a copy of it, if asked. Most likely - at the interview, if there is one.

hi , i think I have almost the same case.
I applied for advisory opinion right after my interview, because the immigration officer wasnt sure if i was subject or not because i came here 3 times and one of them i got not subject.well, finally i got a letter from the officer asking me a waiver recommendation for the 2 year rule and I just did it last week.But like i said I applied for the advisory opinion like a month ago and i just checked online and DOS says that I am not subject.
So, do i need to wait for the answer ,i know it will take long (because i just sent all the documentation for the waiver), or it is enough with the DOS answer even when the uscis officer asked me in a letter for a waiver recommendation because he said i was subject.????? :confused:

I don't know what to tell you.
I'm soo confused myself.
I need my advisory opinion to change my status, the DoS website says that letter has been sent on September 26th. I still haven't received it.
I called them twice, took me half an hour to reach visa officials, they were very rude and they just said that letter should come one or two months after the date stated on the website.
So I don't know... Im so anxious to get it but can't do anything..
If someone knows, pls come forward.

Anyway, we can't do anything but wait.

Hi everyone,

For the ones in need of help...
I finally got my finding letter, after 3,5 months of waiting.
Anyway, I called Visa Office today, 202 663 1225... Earlier, I figured out fast way to reach operater... It goes like this 1 2 2 2 0-make a little break in between dialing these numbers.
I waited few mins and nice operator answered the phone.
When I said that I need letter as soon as possible etc she just said, no problem, I'll e-mail it to u.
Letter was on my e-mail in 5 minutes.
Thank u visa officcer, I am finally free :) :) :)
