Question regarding i-485

Hi All,

I have a question regarding i-485. :confused:

Question: My wife Labor certification got approved and she applied i-140 and i-485 together. She completed her masters degree here and she applied i-140 in EB2 category. Though EB2 dates are current INS sent her i-485 application back saying that dates are not available. They didn't mention whether her i-140 accepted in Eb2 or Eb3. Please let me know what is the next step we need to take here.

Any suggesions in this is greatly appreciated.

-------------- it seems her PD (the day LC was filed) is not current.
EB2 or EB3 depends on the LC check the calumn 14 on form ETA750A
** she needs to check the LC and find out the PD and if it EB3 or EB2 she can find out or contact lawyer who filed I-140 he will let her know if her I-140 is EB3 or EB2 ( it seems to be EB3 becase if EB2 they should have accepted her I-485 becase EB2 is corrent at this time for India or china born)

Master degree does not necessarily make her eligible for EB2. Make sure her LC filed in EB2.
