Question on Status ?? Is it H1 ?? or Is it H4 ??

My wife is in the following position.

I would like to know the answers to the following
questions

1. What is her current status ?? Is it H1b or Is it H4 ??
2. Will she be having any problems, if she goes for
Visa revalidation(for H1 validation) in India or
in Vancouver.

11-Dec-2001 -- H4 approved(based on my H1)
H4 valid dates in Passport - 11-Dec-2001 to
10-Dec-2003
18-Dec-2001 -- Entered first time in U.S on H4

Second H4
---------
11-Dec-2003 -- H4 Approved(based on my H1)
H4 valid dates on H4 approval form
11-Dec-2003 to 10-Nov-2006
(No stamp in passport for these dates)

First H1
--------
Valid Dates -- 01-oct-2004 to 30-sep-2007
SSN applied -- 20-oct-2004
SSN Received - 23-Nov-2004

She never received any PaySlips till now.


But, she plan to START working from 14-feb-2006.
She will be receiving payslips continuously
from now on.

FROM INS BOOK OF RULES, SHE DOES NOT HAVE ANY STATUS NOW. tHE DAY SHE CHANGE THE STATUS FROM h4 TO h1 SHE IS NO MORE IN h4 STATUS.
hER h1 APPROVALS COME WITH i 94 AT BOTTOM, MEANS HER i 94 CAVEAT IS h1.

Since she has no pay slip almost 1.5 years, her H1 status automatically void.

If she goes out for stamping, there is no gurantee she will be issued a H1 visa in her pp.

Only possible thing is , go and work and get payslips, but refrain from getting visa in the pp atleast two complete years.
