Hi,

My GC expires on Apr. 2012. I'm planning to go overseas to work for 2 or more years, leaving this Dec. I'm thinking to do the followings. If you see any issues for this procedure, please help me with advice.

1) Apply for reentry permit (I-131) in Oct. Get the biometrics done and leave US in Dec. I’ll keep the US address (my relative) and get the re-entry permit delivered to there. He'll send the permit to me overseas.

2) Apply for GC renewal (I-90) while in overseas (By asking my relatives to mail in the I-90 form) on around Dec. 2011. Once I get the biometrics notice, come to US for the appointment. Leave US, get the new GC delivered to the US address and ask my relative to send the new GC to overseas. I didn’t see any specific requirements of physical presence in US when applying the GC renewal so I thought it's ok.

Thanks a lot in advance.

I am facing roughly the same situation as yours, albeit earlier (not in 2012 but right now). I will share my personal experiences with you while things move on. Chris

hi

Your re-entry permit can be delivered from the US to overseas even though you have to apply for it IN THE US and process the biometrics IN THE US. They're going to send your RP to the US embassy in where you will be staying.

I applied for the re-entry permit in the US and had it delivered in Korea. there has been no problem so far.

I also need to know if I have to be in the US when renewing my green card. anybody knows?

You can be overseas when you submit the application, but the application must be sent to a USCIS address in the US, and you must be in the US for fingerprinting. You can use the reentry permit to return to the US if they haven't issued the renewed card by the time you want to return.

You said that you would be abroad working for 2 years or more. WHO is the employer and would you qualify for a USCIS form N-470? (Read the form instructions before replying, please.) In order to renew the RE permit you will have to return to the U.S.
