Question on Lawfirm issue

Hi Everyone,


I have applied for Green Card and I have my AP/EAD while waiting for I140 and I485.

I have learned that The U.S. Department of Labor has begun auditing all permanent labor certification applications filed by attorneys at Fragomen, Del Rey, Bernsen & Loewy LLP, which is the firm that has applied for my application.

I was wondering if this can adversely affect my I140 approval. or any other adverse effects.

One can’t answer your question. Nobody knows how the advertising was done and what is written on LC forms and I-140
 
I am willing to bet that they are going to have a 'super' close look at every single application and throw out a few. Good luck!
 
My LC is approved and I have already applied for I140, so the major question is that do they accept the already approved LC or the agency looks back at that again

It depends. If they suspect that the recruitment was improperly done than DOL can reopen the LC, or USCIS can hold the entire process.
 
How can I get any information on this? What should I do? Is there anything I can do?
Is it advisable if I travel on my AP at this point, I have had tickets to travel in July.

Make sure you get a copy of all docs related to your case.
At this point, you can't really do much as they haven't sent an RFE or revocation letter.
But it'll be wise to expect some sort of scrutiny from USCIS and try to be prepared to file a response which will prove that yours is a bona fide case.
How good is your employer? Will they support you? You could proactively try to talk to your employer and get them to be on your side.
Also getting an attorney to go through your case details, along with all the LC related and 140 related docs is a good idea. A good attorney might be able to spot and see if there are any obvious errors which will trigger an RFE from USCIS.
For this you'll need your employer's cooperation and all related docs of your case.

The problem is not proving that the case is bona fide, but that the recruitment was carried out correctly. If the employer and/or the attorney violated the recruitment rules, then the LC is in jeopardy.

I work for a big company, they are cooperative, but they have a lot of rules and regulations and I think touching my file with another lawyer but FDBL would be out of question.

i talked to FDBL people and it seems that the law firm had not had anything to do with our cases so it seems that they have enough prrof for the integrity of the case. I am hoping for that.

What I am really hoping is that they don't initiqate an audit on the file as it will delay my case a lot further. If yu guys any information let me know

I know that you have Pending I-485 and have AP.are you still on H1 status or used EAD?if on H1 status till what date your I-94 is valid. do you have valid H1 visa stamp when you want to enter US?

... on this same issue (I mean: http://www.dol.gov/PrinterFriendly/...w.dol.gov/opa/media/press/eta/eta20080752.htm ), I'm wondering if anyone is aware of any backlog from the DOL because of this (btw, i think, im being processed in Atlanta).

I filed my Labor Cert on May and haven't heard anything yet (lawyer expected response date = July the 3rd), Its been a while and would love to know what's a good estimate of an average response time for a labor cert, and then because of the news above, if this is prone to change (most probably).

I don't know about LC, but I got my I140 approved on July timeframe and my LC and I140 both filed by FDBL.
