I am posting for a couple from India who are green card holders and have applied for family based immigration for their son. When they applied, their son was 20 years old (the USCIS receipt says its for family member less than 21 years of age). Now he is 24 years. They have a few questions:
1. Since their son is now more than 21 years, is USCIS automatically treating it as family based immigration for more than 21 years age or the application is still under less than 21 years category?
2. As per California service center status, it seems USCIS is currently processing applications of March 2009 for less than 21 years category. Since their receipt date is 2006, should it have got approved by now?
3. If their application is being processed as greater than 21 years category, how much time does it take now based on current processing time?
