Question on GC thro' employer & USC spouse

gc-thro-spouse

Registered Users (C)
A person has filed for green card thro' employer a couple of years ago, and then gets married to a U.S. citizen and files for a green card through spouse. Does the family-based GC processing slow down because of the pending employer-based application? Is there any affect?
Please share your thoughts.
Thanks.

Simple answer

Yes, it can...

It may slow processing of both applications down a bit.
It is perfectly legal to do both though, but processing of one application can affect the other.
It's a risk.
Anyone else have experience with this situation??

I disagree. Both GC processes can run in parallel without one slowing down the other. The only possible delay would be if both reach the final adjudication stage at the same time and both DO (family based) and SC (employment based) are trying to get hold of the applicant's A-file from "The Cave".

That's exactly what happened to me - delayed both applications for over 6 months - gridlock! We had to use the Senator to help move things along.

From my experience (although everyone's situation is different), just be a little cautious if filing 2 AOS applications. As you say, it's possible that timing makes a big difference with how the applications are handled.

All I know is that in hindsight it may have caused less confusion and delays if there were only 1 AOS application in the works.
