Hi, Great,

Thank you for your reply to my previous post. I am not sure what kind of error they are talking about. I am just scared that the replaced card will be cated from this year. Do you happen to know where can I download from CIS website the one year date back policy? I will appreciate the inputs from whoever else know.

Hi man39.99!

This link I am posting used to work as it was in Federal Register (FR). This was finalized and now must have become a part of some law book. Anyway here is the link

And here is what the last part of this link said:

"f) Decision. The applicant shall be notified of the decision, and if the application is denied, of the reasons for denial. No appeal shall lie from the denial of an application by the director but such denial will be without prejudice to the alien's right to renew the application in proceedings under part 240 of this chapter. If the application is approved, the director shall record the alien's admission for lawful permanent residence as of the date one year before the date of the approval of the application, but not earlier than the date of the approval for asylum in the case of an applicant approved under paragraph (a)(2) of this section. (Amended effective 7/6/98; 63 FR 30105) "


I have even tried to look at 1998's Federal register entries but this cannot be found anymore. Some lawyer can find that in some law book. But I will do some more research on it to find you the working link. Plus I can post full text of this link later on.

It is in the statute, the regulations and USCIS memos.

This is mandated by Congress and only Congress could change it.
