Question for LucyMo and others regarding overstay

Greetings,

I was a student in the US from September '98 to August '03. However, my visa expired in May '03. I was under the mistaken assumption that it expired in May '04.

This resulted in a 5 month overstay, however I was still studying full-time completing the remainder of my courses. I wished to visit the US for my graduation ceremony in December '03 but was denied a visa for this reason.

I would like to be able to visit the US as a tourist in the future. I do not have any plans to study or live in the country. I have a my business, assets and income in my own county and only wish to undertake visits for travelling purposes.

I would be most appreciative if you could guide me as to what my penalty is and how I could move to resolve the situation. I am aware that a 6 month overstay results in a 3 year ban and a years' in a 10 year ban.

Mine was 5 months, 4 of which I was still going to school fulltime.

since you had D/S in your I-94, the ban doesn't affect you. Read up on that. Your punishment - you have to prove non-immigrant intent, just like anybody else, and more so since you overstayed.

Now, did you mean that your I-20 expired in May 03, or your visa? It's important.

Q) What exactly is a D/S on my I-94?
Q) Could you guide me as to where i may read up on my punishment?

Also, it was my Visa that expired in May 2003
