Hi,

I just received my first EAD card. I plan to use AC21 and work for a newemployer after 6 months from now. I have following question/s:

1. Should I have my current employer run my pay roll against the EAD card instead of valid H1 until Oct. 2006 , so as to prove that I worked for the petitioner for 6 months before changing the employer?

2. Or just keep it as it is against the H1?

Thanks in advance.

----------------- Dont use EAD, remain on H1

---------- YES
*** when eligible for AC21 then join new employer with H1 transfer and then invoke AC21. H1 is good back up
Thanks in advance.

Hi Ginnu,

My current H1 which is the 7th year extension is valid till August 2006. Now let us say after I file AC21 this month(without filing H1 from the new company), my employer revokes my 140 and god forbid my GC gets messed up.

Let us say all this happens around January 2006, At this point if and when my 485 is cancelled, can I file a H1 with the new company? In other words after having worked on EAD , can I file a new H1 and start using the H1?

--------- If I-140 approved and I-485 pending more then 180 days THEN only use AC21, if I-140 approved and I-485 pending more then 180 days and past employer revokes I-140 then you will be safe and join new Employer with H1 transfer

---------- Yes if you maintain H1 status
In other words after having worked on EAD , can I file a new H1 and start using the H1?
------- Why creating problem by use of EAD? Remain on H1 status and file H1 extension on time. for more info contact your lawyer

"

i am confused. how can he transfer h-1, he is already on 7th yr extension.
are you saying when using ac21 you can get h-1 transfer for 7th or 8th yr?

is it allowable to get h-1 transfer after 6 yrs..is there any law?? or is it part of the yates memo...??

Hi Ginnu,

Thanks !!
Technically, can I start working on EAD and later if required (when 485 is revoked), can I file a new H1 with the new employer and go back on H1 status?
