Question about Sponsoring Relative with I-130

Hi,

I am trying to sponsor my dad to come into the United States. He cannot get a Malaysian passport because he overstayed in a country once, so he is stuck in Malaysia until he can immigrate to the U.S.

My question is: If I get an I-130 approved for him, could he get a U.S. passport through the U.S. embassy in Malaysia? Or would he still have to stay in Malaysia until THEY issue him a passport? Thanks!

Of course not. An I-130 merely gives him an immigrant visa, not US citizenship.

Why would the Malaysians not give him a passport if he overstayed somewhere else, assuming he is a citizen??
 
Is he a Malaysian citizen? Is there a regulation in Malaysia not to issue passports to citizens if they violate immigration regulations outside Malaysia? If there is such a regulation, I will be surprised but I do welcome it. I wish Pakistan had such regulations :)

So basically he is stuck there until they are giving him a passport, even if he gets an immigrant visa from the U.S.?
 
He is in Malaysia and they won't give him a passport because he overstayed another country's visa? That's weird... there must be something more to the story. Was he deported, and Malaysia had to pay some of the cost of returning him to Malaysia?

That's a question about a Malaysian regulation. I don't think you'll get any useful answers here. Talk to a Malaysian official or a lawyer in Malaysia.
