Question about sponsor

Hi guys!

I was under the impression that the sponsor must be either a citizen of the US or a PR. But today my father was at the US embassy and the official told him my sibling (who is neither, but is a legal non-immigrant resident of the US) can sponsor me. So of course I was totally confused (but thrilled!) and googled the sponsor forms. I saw on Form I-134 that on option E, it gives the option of a "lawfully admitted nonimmigrant" as the sponsor.

So I'm asking you all to confirm this for me before I start jumping for joy! :p. I'm wondering if the CO assumed my sibling was a PR and if that's the reason he suggested she sponsor, or if nonimmigrants can actually do the sponsoring.
I plan on emailing the embassy and asking for confirmation, but I'm too impatient.

Please help ASAP!! Many thanks!

For the DV lottery process you do not need a sponsor at all. The primary applicant (the selectee or winner) is the sponsor for himself or other members of his/her family on the DV application.

Some people are asked to prove their ability to support themselves and in that case having a "sponsor" can help (if you can't show savings in your own name) BUT the I-134 form is not legally enforceable so the "sponsor" cannot be forced to be responsible for you.

So don't stress whether your sibling is eligible to sponsor you or not. By all means have him complete a I-134 form or show other evidence of how you will support yourself.

Hi Britsimon,

Thank you for your reply.

Yeah I know it's not technically required, but the embassy where I process it does require it as a matter of routine apparently. On top of that, I am not able to provide proof of funds over $10k, even though I'll be completely independent (my parents will give me the money to settle). So I need to have a sponsor lined up just to have everything go smoothly.

OK, then since it is a matter of routine they cannot apply a rule that says the "sponsor" has to be a perm resident or whatever. If I were you I would line up that form with your sibling but also have information ready regarding your parents financial situation and perhaps a letter (or I-134) from them too as they will be supporting you. Anything you can show to demonstrate your financial situation and support will be helpful.

Good luck!
