Question about I-130

errorrrr

I am 21 years of age and a naturalized U.S. Citizen, and want to file petition for my Mother and Step Father who are both New Zealand Citizens. I have question about the process. They both live oversea in New Zealand, they traveled here on the Visa Waiver Program.

1. Do I need to file I-485 if they do not plan to change their status while I send the I-130? In other words, they will be going back to New Zealand when their visa waivers are up.

2. How long does it usually take for them to get their green card?

3. What other form do I need to file besides the I-130? Mainly do I need an affidavit of support showing that I am economically capable? Since I am only a full time university student in New York right now, I dont have a full time job.

4. Besides the I-130 Fee, what other fee do I need to pay?

Thank you all in advance.

1) no, you shouldn't file I-485
2) less than a year for consular processing to get their immigrant visas. As soon as they cross the border with the visas, they will become permanent residents and get their GCs in the mail.
3) right now - just I-130 and whatever supporting documents it requires. In the future you will receive correspondence from National Visa Center with further instructions.
4) at the moment - none. In the future - for fingerprints, affidavit of support, visas, medical exam, etc.

thank you very much... can someone tell me how much the fees are for each of those things?

Also, from what I know about step parents is that if my step fater married my biological mother before I was 18 years old, I can filed the I-130 for him as well. However, my case has a special twist.

My step father married my mother before I was 18, however, after I was 18, they divorced for 2 years. Later, they remarried AFTER I was 18 years-old. So I am wondering if I can still file the I-130 for step father as well?

I have another question.

Once, I file the I-130, can my parents still reenter the U.S. with Visa waiver using New Zealand Passport?

Also, if I file the I-485 along with I-130, can they still leave the states back to New Zealand and come back to the United States?

Thanks a lot!
