Question about extend one more year after 6 year of H1 Work visa.

Hi. I am sorry if my English is not that much perfect. I am writing to help my friend. She is in America with H1 Work Visa. It expires December 2007. Well, her company is sponsor her for do Greencard. But it cost lot money for her. She wants doesn't need Greencard from company, because she will marry or go back to her country in end of 2008. So, she want to extend her Visa one year. I reading here, people can do it? Her company and company lawyer say she cannot. She must file for Greencard inside the next few months, or go back to her country when Visa expire.

I am hoping someone can tell me if "yes" or "no", for possibility of get one year extension. Thank you so much!

I assume that Dec 2007 expiration is after 6 years with H1 in the US, is that correct ? If so, she can not extend beyond Dec 2007 without Green card application. If she wanted another 1 year with H1, she has to file LC application(a part of greencard application) before Dec 2006.

Or If she has spent a lot of time out of the US last 6 years for any reason, she can extend by that time.

Hello! Thank you. Yes, she was here for the six years with H1 in the U.S. Six year expire is December 2007.

No, she spent almost everyday in America for the six years.
LC Application, that is part of Greencard filing, I see. So sad for her, because lawyer say she have to pay so much money. Almost ten thousand dollar.
 
SHe doesn't have to go through the entire GC process. SHe can file for Labour (LC) which shouldn;t cost more than $3000 with all lawyer's fees. HEr lawyer is probably cheating her as the amount ($10000) is too high. Ask her to consult different lawyers and get a quote.
