Question about attaining birth certificate records.

I need birth certificate official document but my parents only have a copy of my naturalization record. I was born abroad and became a US citizen through naturalization. Can I still apply and attain a Consular of Birth Abroad certificate? Or would I have to go to the foreign embassy for my birth records? I am 31 yrs old.

My parents said I would have to go to the hospital I was born in to attain a copy of my birth certificate. I hope they are wrong though, because that would mean I have to travel to Taiwan, where I was born, and I really doubt they are going to still have my birth records at the hospital I was born in, because it has been 31 years...
 
People who acquired US citizenship after birth via naturalization are not eligible for a Consular Report of Birth Abroad.

Town/state authorities usually keep birth registration records for over 100 years, so if your birth was officially registered, you should be able to get a birth certificate issued from there. Do your parents live in Taiwan now? Usually parents are authorized to obtain birth certificates for their own children. Some places extend that to grandparents.

If you don't have a family member in Taiwan who is authorized, you might be able to arrange something with a lawyer in Taiwan who can obtain the certificate for you.
 
What about going to the Taiwan embassy here, would they do it for me? I did some research into this forum, and learned some new things. What about a Non Availability Certificate, and an Affidivate from my parents? Would those be easier to get and suffice for birth certificate for most government institutions? The employment development department is asking for my birth certificate.

In the letter the employment development department sent to me, they said they require "copy of your birth certificate issued by a local, state or federal agency, or a foreign government, or other official certification of birth." They are very strict in that they want a birth certificate document. I've tried giving them copy of my passport, naturalization documents, and they've rejected all of those.

This is a US immigration forum, not a Taiwanese government document forum. We don't know how to get a Taiwanese birth certificate.
 
Why do you need your birth certificate now? Do you have your old foreign passport? What birth document was used when you applied for your green card (A birth certificate is needed for getting a green card)?

We don't have a clue about government agencies in Taiwan. You and your mother will have to somehow find out which department handles the issuing of birth certificates. Talking to friends or relatives who have recently had a baby there and gotten a birth certificate might help. Or the hospital where you were born may be able to direct her to the right place. Searching the web may also give some clues.

Why do they need your birth certificate? If they're a US company or government agency, it might be illegal for them to specifically require your birth certificate when you have other US government-issued proof of your age, identity and citizenship.

They say my birth date doesn't agree with other government records. I think it is because the DMV when they issued my driver's license, they inputted the incorrect birth date. Therefore by law, they cannot confirm my identity as required by regulations.. My dad says that they are just trying to give me a hard time. It certainly seems like it.

I just contacted the hospital I was born at. And they are requesting documents in order for them to look for my birth certificate. So they may have a copy of my birth certificate, but the problem is we don't have the documents they are asking for..

I'm just going to assume for the worst case scenerio, that I cannot get the birth certificate. So I am hoping that a Non Availability Certificate and Affidivate would do as an alternative of proof of birth. I've read on this forum some posters had used one of these as a alternative to birth certificate and it is accepted for the US immigration government agency. If anybody has any helpful info more about this, please let me know. Thanks.

I called the taiwan embassy, and it sounds like they can resolve this for me. I just have to renew my taiwan passport with them and do a few other steps at the embassy and then I should be able to get my birth certificate.

So you're saying the birth date on your driver's license doesn't match the birth date on your US passport and naturalization certificate? Have you tried to correct the license using your passport and naturalization certificate? Or is this thread about the problems you're having with correcting the license itself?

Non-Availability Certificate is for those who never were issued a birth certificate, not for a case like yours where your birth certificate was created but you no longer have it.

Yes, and I'm just guessing that was the problem. I wrote to EDD in the appeal form, and when/if I see the judge, maybe all they will ask of me is to fix the date of birth on my driver's license with the DMV. But I think chances are, they will give me a hard time, and require me to give to them a copy of my birth certificate. Right now, I think it might be too late to fix my DOB on my driver's license, as I think it will not affect EDD decision on requiring my birth certificate, although I should probably fix that now or later after I get this resolved. Maybe I will go to the DMV tomorrow to tell them they messed up on my driver's license DOB.

I'm surprised you didn't try that long ago. Like within a few days after receiving the license.

Did you show the wrong-DOB driver's license when filing the I-9 with your employer?

I don't remember, but the employer may have xerox a copy of my DL when I got the job, yes. Maybe that was the reason for all of this.
