Hi All,

This is my case please help me understand the way out.

I got my H1B in Oct 2004 and my VISA was stamped till Jan 2007.
In Oct 2006 i applied for an extension thru my employer and got my I-94 extended . Now my new I-94 / pettion reads " Valid 24 Mar 2007 through April 2008" .

I am planning to Visit India in Dec , so as i understand i will have to go for my personal apperance at US Consulate.

Q 1.> In that case when my Passport get's stamped again , would it be stamped till April 2008 only or it can be stamped for complete H1 Validity period that is aprox. around 2009 in my case. ?

Q 2. > Is there a period lock before which i should go ( 90 days or something ) for my re-stamping ?

Q 3 > What happens if i want to get my VISA stamped after Apr 2008 , will i have to go for a Fresh H1 Application ?

Waiting eagerly for your responses. Thanks in advance.

------------- you will get visa stamp till validity of your H1 extension approval that is April 2008
Q 2. > Is there a period lock before which i should go ( 90 days or something ) for my re-stamping ?
------------------------check the dates on site of US Consulate Mumbai, if you get date in December that is OK, you need visa stamp before you come back to US
Q 3 > What happens if i want to get my VISA stamped after Apr 2008 , will i have to go for a Fresh H1 Application ?
-------------------------YES, your employer can file H1 extension 6 months advance of I-94 expiry date, you can file Extension NOW. H1 extension approval may take 3-5 months after extension reach the USCIS, if file with Premium Processing then you can get H1 extension in 20-25 days. when you go with new H1 extension approval to get H1 visa stamp you will get H1 stamp till H1 extension approval notice.
If LC for you is filed and I-140 is approved and unable to file I-485 then one can get H1 extension for 3 years.

Waiting eagerly for your responses. Thanks in advance.
