Property Tax and Bankruptcy

Hello All:

I am currently looking to apply for citizenship but I have a concern about the section which ask if I owe any taxes. I normally would have answered yes to that question but from some of the research I made online, it says the section was asking if I owe IRS which I dont. But we are yet to pay our property tax for our home for last year. Also, my wife and I are looking to file for bankruptcy as we couldnt meet up with some of our monthly obligation because I have been out of work for over 8 months.

Apart from the above mentioned, I do not have any problem with the law with the exception of a few speeding ticket which from what I learnt so far, is not an issue to worry about.

I am hoping someone who has a related issue or knows someone with a related issue in this regards would help shed some light.

Thanks

When we submitted our N-400 application, there were no dues reported by IRS, after submission, we got a letter showing that we owe some money this was due to error in e-file and we submitted amended forms. We are waiting for the reponse from IRS.

At the time of our N-400 application, The answer was 'NO' to any taxes due but at the time of our interview the answer was 'YES'. In our interview IO asked the same question which was on the application. " Do you owe any taxes?". We answered 'YES' and showed the letter received from IRS and copies of amended forms. The IO gave us one month time submit the required information. We passed the interview/civics test and looking for oath letter as soon as we submit the response.

The bottom line is we should not lie about taxes. In your case, you already know about the due taxes, the answer would be YES. At the time of your interview you can submit IRS documents or payment plan. You would be OK.
Under current economic situation and recession, I think, bankruptcy and unemployment situation should not prevent you from getting your citizenship.

I would put no, you don't owe the IRS any money, property taxes are a different matter and there is no qquestion asking about property taxes.

Bankruptcy, credit scores and all that stuff has no bearing on your application.

Thank you guys for you help. I have one more question. I dont know how many months of our bank statement I need to include in the N-400 application. If anyone has an idea, I will appreciate it a lot.

Thanks once again

John,

You may have a bigger problem with the Property tax. A lot of Counties are now using the fast-track method of listing the property for Tax Auction after 90 days failure to pay from the delinquent date. You should check with your local County on whether they are using this new system or not.

My local County proudly informs us that now 99.5% of all taxes are paid on time every year due to this new system. It got my attention, although I was never late but now when I pay, I check their website a week or so later for the tax owing on my parcel number. I like to see they got the payment. Swift Justice.
