485 cases processing shifted by few months ??
Hi All,
Advice appreciated in my case:

Recently I got a pink slip, for one and half months, probably I am fine as I will be on payroll.
I might have to apply for H1 and transfer my 485. Do you see any problem in the 485 case transfer if the job description is the same or similar ?
A premium processing for H1B takes 14 days it seems.
How many days does it take for 485 to be transferred ?
Does the 485 transfer has to be completed before my current H1 expires ?
Unfortunately I applied my EAD just before I got this notice, about 10 days back. How many days does it take for INS to respond with RD for EAD
[I have to count 90 days from RD :-( ] ?
Reasons for the approvals date not moving ??

I happened to talk to an attorney about my case and her response was:
INS is heavily back-logged and the old cases where FP is approaching expiry are allowed to expire they may have to go for second FPs as it cannot be avoided.
To ease off the burden that is on INS with the strict regulations and zillions of checks they have to do, they might skip a few months and start processing from then, i.e., right now processing is suspended at 11/16. Now they would start processing from May 2002 onwards as their FPs are fresh and those cases can be dealt with without FPs getting expired. Otherwise it is sort of cascading effect - INS has to schedule FPs for all which will be too much work for them.
Can anybody verify these facts ? Are we getting approvals in the first or second quarter of 2002 cases ?

Nothing personal to you but I am depressed by such news where the half cooked solutions are dished out by BCIS/Laywers.
Anyway please post your comments as a seperate thread because of 2 reasons:
1. This is a piece of information that would not get the attention it deserves in this thread.
2. This thread is one of the lifelines of us lost souls so any thing other than progress should not be displayed here (I request you all!)

I am sorry I didn't mean to depress the group.
I wish what I said were wrong !! My case also is close and I want to get through soon. But what if that is a reality what can be done ? We can't close our eyes on it. In fact it is a bigger problem for me.
I have been following up this link for quite sometime and I appreciate the effort being put by volunteers to get some meaningful information and give some direction.
I would be happy to hear another legal opinion stating that it was just a consideration and action might not be taken towards that end.

I think it's more proper to consider cases "touched" when status changed from Resumed to RFE Sent. We can call it "touched for the first time"
Would be nice to track those cases and see whether BCIS is picking up brand new cases from the shelf and with which NDs.
Could you please give us a favor and sort your Global WAC list by the following fields:
1. Current Status
2. Prev. Status
3. Status Date (Descending)
Then just take out only the chunk that has "RFE Sent <- Resumed" and post the list here?
