Profit to Non Profit transfer

I am currently working for a for profit organization and am thinking of moving to a non-profit organization. I assume this would be a new H1B rather than a transfer as both are different categories. If later on, I decide to move back to a for-profit company, will I be counted again towards the cap? (since I have already worked on the for profit H1B for a few years, I think I shouldn't be).

Also, can I start working after initiating the H1B for the non-profit position or do I have to wait until the H1B gets approved?

Thanks a lot.

H-1B transfer is not subjected to quota but a new H-1B is. Please clarify from a lawyer how different the visa from a profit and non-profit employer will be.

What do you mean "new H1". Every H1 is new. Even transfer is new H1.

When you come back to profit H1, you won't be subject to quota again(as long as total H1 time is less than 6 years).

manwithnoname and GotPR? : Thanks a lot for your responses.

I thought that H1 transfer was not a new H1, thanks for clarifying. If I join the non-profit organization, will there be any problem in applying for my GC? (since I was working on a for-profit H1 before).

What if my spouse applies for a GC and adds me as a derivative. Does switching H1 types (from profit to non-profit) cause any problems with the GC process?

Thanks a lot again.

All the H1 application is new petition, but transfer will not be subject to quota.

No issue
