Depends on your service center where you applied from.

If your 140 is already approved and have completed 180 days from the date you filed your 485 you can change jobs.

Hi dynobuoy!!

When the 180 days counting starts? I applied 140/485 concurrent filing. Is the counting starts on the day I got I-140 approved OR the day I applied 140/485 ?

Check your I-485 filing receipt it has receipt date and 180 days are counted from RD, if you want to use AC21 then I-140 must be approved and I-485 pending more than 180 days from RD.

RD= receipt date

Does the AC21 mandate that you need to have your I-140 approved? I thought it is not explicit on the clause because the concurrent filing did not exist when AC21 came along and a 180 day wait on the 485 implied that the 140 had been approved.

It is not true now. However, isnt it just a safe practice to wait till ur 140 gets trhu before u switch jobs?

----- For AC21 you need I-140 to be approved and I-485 pending more than 180 days and same/similar job, the recent AC21 august MEMO was issued after concurrent filing was started and applicable to all the cases

Disagree. But do find these interactions agreeable.

These memos appear to mainly address the situation where the I-140 is approved, the 485 is in limbo and the employer has changed. Various what-ifs related to that.

I still have not seen anything that mandates that you need your 140 approved to use AC21.

What do you mean using AC-21? Is it just changing the job? Or is it informing the CIS?
Before the approval of I-140 it can be revoked at any time. SO if you inform the CIS that there is not standing offer then they will not issue you immigrant visa. So automatically your I-485 become void.

But if you talking about just changing the job without bringing CIS (Both from employee side and employer side) into picture it should be ok.
