I just came to know that my I-140 is approved. I also filed my 485 concurrently.
My question is that now as my I-140 is approved, will they send the approval notice to my lawyer and then he will send it to service center/department who is processing 485, for further process or now it is between I-140 and 485 department?
Will appreciate your comments.
I wouldn't worry about sending a copy of I-140 approval notice to USCIS. It will take forever just to get forwarded to the right department. They automatically check on pending I-485 when they approve I-140 - so if the PD is current, your I-485 processing should begin right away (or whenever they start processing I-485s with your RD). If they need anything from you, let THEM ask you for it.
The reason I feel fairly certain about this is that I myself pondered the same question once. Only in my case, I filed I-485 while my I-140 was still pending, and it just happened to get approved WHILE my I-485 package was in transit to USCIS! So from being based on a
pending I-140 it became based on an
approved I-140. I remember getting all nervous that (when they receive I-485) they won't see that my I-140 has just gotten approved (since I only included a copy of I-140
receipt notice with the package). I called Customer Service and they assured me that all such checks are made routinely upon I-485 receipt; also they instructed me not to send any copies of the I-140 approval unless THEY request it.
My I-485 was approved with no problem a little over 2 months later. So, if I was covered in such a unique situation, they would definitely have procedures covering a classic concurrent filing situation such as yours.
So, congratulations on your I-140 approval - you're half way there! Now sit tight and watch out for that FP appointment letter (if you haven't received one already). And good luck!
