Priority Dates to Retrogress in January

People who already filed 485 they can continue to renew EAD and parole visa but their 485 cannot be approved unless their priority date is current.

I hope atleast this retrogression will help people like me who filed their cases long time back and are still waiting while people who recently applied getting their approvals in no time. I mean no offence to people whose prority date is very recent but its just that old timers like me are still waiting with no end in sight.

For a moment, I thought about those lucky souls who got concurrent approvals for 140&485 with ND 2003 Nov - EB3. Too bad they did not buy lottery tickets on the day they applied for GC

I totally agree with you. They should have some rules or guidelines to follow be it FIFO, LIFO or some thing else. Probably they themselves do not know what it is. It is probably LOTTO !! I think every day morning NSC officials close their eyes and from pile of 1000s of cases pick one for the day. If you are lucky, it is your day or else it is end less wait.
 
PD JAN-04 When shud I expect 485 case to be processed ?

Hi Gurus,

Does any body have any idea (if someone has taken lawyer's opinion) as to when a person with PD JAN-04 expect his 485 case to be processed.

Labor Filed : 20 Jan-04
Labor Approved : Jul-04
140/485/EAD : Oct-04

Depends on your country and category. For EB3 case from India, China and Phippines PD has just been released and it is Jan 01, 2002. Well, if you are from one of these countries and your and EB3, how long it will take for PD to become current is anyone's guess. It could be 6 months, 2 years or even 4 years.. no one can predict. But when I researched on past trends when PD used to be backlogged it has been one to one, meaning in you are 2 years behind it will take 2 years to catch up. But that is just an approximate guess work.

It could be more if DOL backlog reduction is successful.

I am from India and my case is EB3. So as per your research, as my PD is Jan 31st 2002, it will take a month???? I think that's a wishful thinking. I hope you are right. But now I am shattered. All my dreams are gone. NSC left us in no man's land.

GM, I'm sorry to hear that, but the truth is I feel in no-man land since the begining of the process.
Whatever they do, I hope they get things in order, and approve cases in a sensible manner.

Sorry, I didn't mean that your approval will be in a month. What I meant is it will probably be a month for your PD to catch up. So in the next month or in a couple month's time the visa bulletin would probably say that PD is 02/01/2002. That's just a guess as I said. No one knows for sure. If this PD is something like NSC processing date and gets stuck at 01/01/2002 for 8 months, then it is bad. If indeed next month's visa bulletin says PD for EB3 is 02/01/2002 it means you are current and have a visa number and your 485 is eligible to be approved, not guaranteed to be approved and definitely it does not mean it will be approved in a month. The hope as others have mentioned here is, this will atleast stop random approvals of cases filed in Nov'03 or Feb'04 and will give oldtimers an opportunity to see the light of the day.

I have couple of questions. Are they going to finish all EB1 and EB2 before they can start processing EB3 cases? I mean those EB1s or EB2s applied yesterday too?

What is the impact of H1 seventh year extension?

I don't know for sure if it is your current nationality that matters or where you were born. I vaguely remember reading somewhere in this forum only, that where you were born is what matters. But I could very well be wrong and in matters like this which is very serious, I don't want to mislead anyone. If someone has anyone concrete information, it will be good if they could post it here.
 
It's interesting that on the plastic card, you'll see "Country of Birth". Nationality is not listed anywhere. I may be wrong, but I think country of birth is what matters.
 
If they consider the citizenship rather than country of birth then the priority dates backlog for the countries like India, China…. may reduce a little bit. Am I expecting too much?

my priority date ( i mean Labor petition filing at DOL) was sometime in june 99
and my 140 got approved in 2000, but filed 485 only recently a month back.

You think they process my case sooner . Or does it go by priority date and
485 filing date. Any ideas?
