If I have a job title of say "Project Manager" and my company decides to do PERM for me which of the following has to be true for me to go for EB2? Please give some details on each of the queries I have below

1. My company had to place ads for me listing that the job requires a Bachelors with 5+ years of experience or a Masters degree with 2 to 3 years experience (I fit the masters degree criteria so I am hoping my company would place ads this way)

2. If the prevailing wage for the position based on location (California) is as follows,
Level 1: 80k, Level 2: 90k, Level 3: 100k, Level 4: 110k
Do I have to be at level 3 or above to be eligible for EB2?

Lets say I meet condition 1 above but do not satisfy the condition 2, can I still be eligible for EB2?

Please help.........

You have to meet whatever PW that they set for your position. It doesn't have to do with whether you are EB3 or EB2. So once the description is picked out (BS + 5 OR MS >= 0), then the prevailing wage will be determined by DOL. Your company doesn't necessarily have to pay you that wage at this time, however they need to prove that they are capable of paying you that wage when you get your GC.

Thanks

Thanks Immigraboy. What I hear is, when the attorney submits my PERM app to the SWA the software would determine what my prevailing wage level would be? Right.

But I did not get the part where you say EB2 or EB3 has nothing to do with prevailing wage level.

I thought if you have to apply in EB2 you would have to be at a certain level. In the above example if the software returns a level 3 wage of 100k and I make only 95k do I still get to apply under EB2?

Best way to proceed is, give your job title and description to EDD they will evaluate and determine the previling wage for you.

Usually there is no such tirle Project Manager in the job category, it fall under General/operational Manager category, requires several years of experience to qualify. (Masters with one or two years may not qualify for PM but qualify for EB2 Sr Programmer/SW Engineer.)
