premium processing retuned

hello

I think i am the first one to have faced this and wanted to help others not to make the same mistake.

i sent in my h1-b for premium processingon onapril 1, 2004, it reached CIS on april 2, 2004 (i-129, I-907, stamped april 2, 2004). they have retuned it to me back today. the reason stated was that the cap for fiscal year 2004 was reached and asked me to submit on or after april 1, 2004.

it didn't make any sense to me later when i called the immigration help desk they said that they are not accepting premium processing and will not till sept. 15, 2004. i am not sure what should i do, i am not even sure if the above information is right.please help.

should i send it for regular processing , this is the second time it was returned, first time my application reached on feb 19, 2004, same cap issue. i am not sure if it was the LCA 9035 form, because it was dated for january 27, 2004 to january 26, 2007.
i used the same LCA form that i used when i sent the first application.

That is strange. I have heard about this, but this is against CIS' earlier official announcements. We are ourselves filing all cases premium. Anyone else has had the same problem?

can u please let me know if they have deducted the fees from anyone of the cases that you have filied for premium processing, i mean are they processing?

also i work for a county and can not have a attorney on our behalf, so we have to do everything ourselves, however it would be of great help if you can clarify this to me,

is it ok if my LCA is valid from january 27, 2004 to january 26, 2007 and i apply now and with a start date of oct 1, 2004. Please help

Hi Rajeev,
I myself had the same problem. My application with my premium processing fees has been returned. But it did not mention anything like Sep 15 etc. My application was send to Vermont Service Center.
My LCA had dates from May 2004 to Oct 2006.

This is a follow up of my case which was returned by mistake. Thought would help others.

My H1-B was returned to me on April 13th and i mailed it back on the same day. It was a mistake on the part of TSC. They received it on April 14, 2004.I e-mailed TSC and they sent me a reply saying that it was thier mistake and asked me send it back to them.

Finally we got an e-mail from the TSC. I now have an reciept number. will keep you all updated.
