Guys I know this has been touched on before but has anyone any ideas on how USCIS look at cases when dates are not current. I filed my I485 in July. My EB3 has a priority date of Oct 2005 Rest of World.

Do you think that if a case needs an RFE or may be denied would it happen sooner rather than later - or do cases which are not current just sit there until they can be adjuducated.

It seems wrong to me that you are kept waiting and then told your case is denied 3 or 4 years down the line. I have no problem waiting but it would be much easier if you knew at least what the outcome will be.

Also I had an LUD on jan 8th 2008 although my online status stayed the same.

There are many theories on this. It seems that a lot of people from retrogressed categories got a LUD around Christmas/New Year. Some speculate thats the service center moving files into storage, and that they focus on current I-140s instead. However, nobody knows. Its all just speculation.
 
Thanks for that. Sounds promising although I guess there is no sure way to find out whether your case is approvable or not until your priority date is current.

In my personal opinion the immigration system would be a lot fairer if your case was approved or denied quicker, even if you have to wait many years for the actual green card. But who am I to say!
